What is the purpose of CBP Form 823F?
Any person coming into this country who is suspected of having a terrorist link is required to complete a CBP Form 823F. An “immediate family member” of a U.S. resident is defined as: A spouse or unmarried dependent of the alien; Child of the alien; Parent, a step-child or legal ward. [9CFR § 237.1(e); 9CFR § 241.11(1)(B)(ii); § 242.(a)(1); § 252.(b)(2)) This will include the immediate family members of lawful permanent residents, as well as other U.S. residents. For example, individuals who apply for residency rights, are granted citizenship under U.S. law, apply for green cards due to a close relative's citizenship, or other similar scenarios are also covered: Any person who, as a minor, was legally adopted into this country or who otherwise was placed in this country by a foreign country or its nationals; or Any person who, as an adult, was brought into the United States with the intention of marriage and who has continuously resided here since then.[10] CBP Form 823F is also required by the State Department for: (A) Foreign diplomatic and consular officers serving as consular officers; (B) Persons whose status as a refugee or asylum applicant is currently under review. Where do I file the document? The CBP Form 823F is available electronically from CBP or by mail.[11] I am not a U.S. citizen. Can I still use the document? While the document is a U.S. visa, it needs to be signed by a consular officer at the United States Embassy (or other consular post of that country).
