FAQ - CBP Form 823F

What is the purpose of CBP Form 823F?
Any person coming into this country who is suspected of having a terrorist link is required to complete a CBP Form 823F. An “immediate family member” of a U.S. resident is defined as: A spouse or unmarried dependent of the alien; Child of the alien; Parent, a step-child or legal ward. [9CFR § 237.1(e); 9CFR § 241.11(1)(B)(ii); § 242.(a)(1); § 252.(b)(2)) This will include the immediate family members of lawful permanent residents, as well as other U.S. residents. For example, individuals who apply for residency rights, are granted citizenship under U.S. law, apply for green cards due to a close relative's citizenship, or other similar scenarios are also covered: Any person who, as a minor, was legally adopted into this country or who otherwise was placed in this country by a foreign country or its nationals; or Any person who, as an adult, was brought into the United States with the intention of marriage and who has continuously resided here since then.[10] CBP Form 823F is also required by the State Department for: (A) Foreign diplomatic and consular officers serving as consular officers; (B) Persons whose status as a refugee or asylum applicant is currently under review. Where do I file the document? The CBP Form 823F is available electronically from CBP or by mail.[11] I am not a U.S. citizen. Can I still use the document? While the document is a U.S. visa, it needs to be signed by a consular officer at the United States Embassy (or other consular post of that country). For legal reasons, a U.S. citizen cannot sign the form. How do I use the form? Fill out and return the form to the U.S. Embassy/Consulate in your home country. NOTE: In cases where the citizen is a refugee, asylum seeker, or is a dual national (i.e., does not require a visa to enter the U.S.), a special procedure is underway using a DHS petition. See the Asylum, Refugee Protection, and DREAM Act FAQs.

When do I need to complete CBP Form 823F?
The time of completion for CBP Form 823F is as follows: The form is to be submitted during the year the alien enters and maintains permanent residence in the United States. The immigrant has no children. The alien has been in the United States for less than three years. How can CBP protect the integrity of the processing of Form 823F? The agency will be required to disclose that it uses a random sample of alien's fingerprints to determine immigration or legal status each year. Will this prevent people from claiming I'm an alien when I am not? No, the law does not require any other way to determine immigration or legal status beyond fingerprint matching. The law is focused primarily on immigration fraud, not people claiming they are aliens. Who are those who claim they are aliens? Many of those who falsely claim or are suspected of having made a false statement of alienate have a disability that could be made better with legal help. There is no way to verify that the person is claiming to be an alien, however, since we have no way to verify the status of the person without taking an immigration or other type of law enforcement action, we should proceed with caution. The more we can learn about the true background of a person the more we can protect the integrity of our immigration system from misrepresentation. Yes, it can be done. It takes a few days. You could use an old email. Furthermore, you can then use that email to make your personal copy and upload it with this email. Then you need to mail those “cbs-form-823-files” to yourself, so you can use them in your personal Copy. You can also add your friends and family to your personal Copy in the CBP. CBP can take this as data if they verify your employment, if your information is collected for a criminal investigation or other investigation, if you are a “nonimmigrant alien” or “green card holder” in an investigation or if you are in the United States under a temporary status. If in your case it is a Temporary Resident Card then it is not likely to be taken further into account or use it for this purpose. How will I know if anyone has entered the United States using CBP's Form 823F? You probably won't. How do I get my CBP Form 823F?
First, you've got to download your federal and state forms at CBP websites. The federal form is available at CBP.gov/forms (you probably need to click “All Forms”, but you can still click “Federal Forms” if you want). The state form will be available at your state government website. The California Department of Justice has an online database of forms, which is where I got mine and is linked from at this site. You can download your forms right from the internet, and there's no need to print them or mail them in. But you might not want to get your form in the mail, even if it looks like it's legal. CBP won't do anything except forward it to you once you've signed it. And then it has to be processed before we can send you a check. I went to the post office as soon as I received my federal form 823F, and they said I don't need a tax ID. What should I do? You should use it. This is an old form, so it needs to be updated. But you can still use the old form if necessary. How long does it take to get my form 823F processed? Your form 823F will be processed within 20 business days, but it might not be immediately. You can check in regularly as you receive the paperwork to make sure it's getting processed. Most people can expect to receive a check within 3-4 weeks of being issued. When will I get my refund? It depends on if you filed your claim electronically or by paper process. If you filed electronically and your refund is coming from the IRS, get everything in the mail to the Post Office Box where you filed your paperwork within 20 business days. If you filed your paperwork in paper, the IRS will process it within 30 days. How much am I entitled to if I file a claim for an itemized deduction? For tax years 2000 through 2016, the standard deduction was increased from 6,300 to 12,000. Many taxpayers choose to claim the standard deduction instead of itemizing. You can choose to have the standard deduction deducted only once or itemize for deductions. Claiming the standard deduction is also good for taxpayers under the age of 65 who make less than 100,000 per year.
